Defense Against Allegations of Domestic Violence
In divorce and custody disputes, a party may use false accusations of domestic violence in an attempt to gain an advantage in those disputes. If a person is adjudicated to have committed domestic violence, there is a presumption under the Family Code that the perpetrator of domestic violence should not be awarded custody of the minor child or children.
